Lawyer's note. Under Art. 300 of the Labor Code, an employee may resign by serving a written notice at least 30 days in advance. Resignation without notice is allowed only for just causes (e.g., serious insult, inhuman treatment, crime against the employee).

- Request your Certificate of Employment and final pay; final pay is generally released within 30 days from separation.

No. Resignation is a unilateral act — the employer's “approval” is not required, only your 30-day notice (or a mutually agreed earlier date).
