Lawyer's note. A promissory note is valid without notarization. Interest must be stipulated in writing to be demandable (Civil Code Art. 1956); courts reduce unconscionable rates, and the legal interest for judgments is currently 6% per annum.

Frequently asked questions

What can I do if the borrower doesn't pay?

Send a written demand letter, then file a small claims case — money claims based on a promissory note qualify, and no lawyer is required in small claims.

Is interest allowed?

Yes, if stated in writing. Keep the rate reasonable — courts strike down excessive rates and replace them with the legal rate.
